Sales Tax and Suggested Donations

Question: If you have a suggested donation for coffee, tapes, meals is there tax?

Answer: No...as long as it really is a donation. If this is a routine proceedure and they can actually choose to pay another amount or nothing at all then the amount could truly be considered a donation. If they must pay to receive the item then it is a sale. Charges to attend and event where a meal will be served does not require the collection of sales tax. Other occaisional charges for a meal are not considered sales requiring the collection of sales tax. If the meal sales are routine they probably are considered sales.
